The Waya Studio, led by app developer @Lily Ren (lily.in.ren@gmail.com) (referred to as "us", "we", or "our"), operates the Waya Live mobile application (the "Service") and the Official Website at https://chat.happywaya.com. This page informs you of our policies regarding the collection, use, and disclosure of personal data when you use our Service and the choices you have associated with that data. We use your data to provide and improve the Service.


When you accept the contract for using the app service, you are deemed to agree to the entire content of this privacy policy. This privacy policy is an integral part of the agreement to use The app service. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Service.

1. Information collection

1.1 Registration Information

When you download the App and create an account ("Account"), we may collect certain information ("Registration Information") about you, such as:

Name;

Username;

Email address;

Gender identity;

Date of birth;

Photographs;

Location; and

Login information for 3rd party accounts that you connect to your Waya Live Account (this could include, for example, your Google accounts).

Once you register, you will be able to review and change this information at any time just by logging in to Waya Live (other than your date of birth and location (which, if you have given Waya Live access to your location in your device settings, is automatically updated based on the location of your device). It is your responsibility to ensure that your account details are kept up to date.

The information we collect helps to enhance the App and verify our users (robots are not welcome!). Registration Information such as your name and photograph may be visible to other users who view your profile page.

1.2 Profile Information

We recommend and encourage you (and all our members) to think carefully about the information you disclose about yourself. We also do not recommend that you put email addresses, URLs, instant messaging details, phone numbers, full names or addresses, credit card details, national identity numbers, drivers' licence details and other sensitive information which is open to abuse and misuse on your profile.

When you post information about yourself or use the messaging function to communicate with other users, the amount of personal information you share is at your own risk.

1.3 Purchases Information

If you decide to purchase any of our paid services, we will process your payment information and retain this securely for the prevention of fraud and for audit/tax purposes.

Waya Live uses automated decisions to prevent fraudulent payment transactions being processed as part of its anti-fraud procedures. In order to do this, our systems check payment transactions for behaviour that indicates breaches of our Terms of Service. If a transaction meets certain criteria that demonstrate that the Terms of Service are likely to have been breached and the transaction is likely to be fraudulent, the relevant transaction may automatically be blocked. Where a transaction is blocked, the user will be notified that their transaction cannot be processed and affected users can contact our customer service to contest the decision.

1.4 Device Information

We may collect information about your device when you use the App including the unique device identifier, device model, and operating system, for a number of purposes, as set out here.

1.5 When you Contact Customer Support

If you contact our Customer Support team in the app, we will receive your email address, and may track your IP address, as well as the information you send to us to help resolve your query. We will keep records of our communications with you, including any complaints that we receive from you about other Users (and from other Users about you) for 5 years after deletion of your account.

1.6 Cookies and similar technologies

When you visit our Sites or when you use our App, we may collect personal data from you automatically by using cookies or similar technologies. A cookie is a small file that can be placed on your device or browser that allows us to recognise and remember you.

2. How we use the collected information

2.1 Purposes for which we will use your personal data

- To register you as a new member

- To provide the Services to you, including:

(a) Maintaining a profile, answering questions, and providing information about yourself;

(b) Allowing you to communicate with other users ;

(c) Enabling you to purchase paid service.

- To manage our relationship with you which will include:

(a) Notifying you about changes to our terms or Privacy Policy;

(b) Communicating with you.

- To administer and protect our business, our Services, contravention or unauthorized use of our Services and your personal data (including security, fraud, court proceedings, troubleshooting, data analysis, testing, system maintenance, support, reporting and hosting of data). For any legal proceedings these rights may be exercised by the Data controller and any of its affiliates, subsidiaries, directors, etc.

- To use data analytics to improve our Services and products, marketing, customer relationships and experiences.

- To respond to requests from law enforcement, including banks, card processing companies and investigation authorities

2.2 Request device permissions

Normal permissions: These permissions are automatically granted upon installation.

(1) INTERNET: Connects to our servers.

(2) BLUETOOTH: Detects Bluetooth headset connections.

(3) ACCESS_WI-FI_STATE: Checks Wi-Fi connection status.

(4) ACCESS_NETWORK_STATE: Monitors network availability, connection status, and connection type. This helps us to prevent data loss or processing delays due to network interruptions.

(5) AD_ID: Accesses Google Advertising ID for personalized ads. If you wish to disable this permission, you can turn it off from "Personalized Ads" in your device settings.

(6) READ_PHONE_STATE: Checks device capability for video calls and tracks active status.


Permissions Requiring User Consent: System pop-up appears when you initiate these features.

(1) CAMERA: enables live-streaming and video call features.

(2) RECORD_AUDIO: allows audio capture for live streams and video calls.

(3) READ_EXTERNAL_STORAGE: accesses photos when you change your profile picture. Only used on Android 12 and below (not required for Android 13+).

(4) WRITE_EXTERNAL_STORAGE: saves photos you take through our app to your device. Only used on Android 12 and below (not required for Android 13+).

3. Transfer of Data

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside your state, province, country or other governmental jurisdiction where the data protection laws may differ than those from your jurisdiction.

3.1. Expect in accordance with the law, the Company takes on the obligation not to sell, lease out, exchange, or otherwise share personal information of Users to 3rd parties unless explicit consent is obtained from the Users. The following circumstances empower us to provide 3rd parties with access to the User's personal information:

- Explicit consent has been received from a user to share his/her personal information to 3rd parties;

- Personal data transfer is needed for the use of the Application by the User. In such cases, we fulfill the demand with a 3rd party in order to keep your personal information confidential.

3.2. To work on advertising campaigns, and behavior statistics, we make use of the service called “Adjust Analytics”, which is provided by Adjust GmbH and is situated in the Germany. Among the information, which we supply to Adjust Analytics, there is your IP address, as well as data used by Adjust Analytics for gathering information about the Application usage by you.

3.3. Together with certain disclosures of personal information described herein, your information might also be disclosed:

- To our lawyers, auditors, accountants, counselors and other expert advisors in the extent which is justifiably needed for gaining expert advice or resolving legal controversy or risks;

- In cases when a disclosure is required for meeting a contractual obligation. We are subject to, or for protection of your fundamental interests and/or fundamental interests of a 3rd party;

- When required to meet the applicable legislation or in the context of an acquisition, merger, or asset disposition by giving notice to users.

4. How long will we keep your personal data

We will retain your personal data for as long as necessary to fulfill the purposes we collected and/or processed it for, including for the purposes of satisfying any legal, accounting, or reporting requirements.

To determine the appropriate retention period for personal data, we consider the amount, nature, and sensitivity of the personal data, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal requirements.

The Personal data is processed at the Data controller's operating offices and in any other place where the parties involved with the processing are located. We also retain backups of the Services, including your personal data, on a rolling basis according to our internal data retention, disaster recovery, and business continuity policies.

We retain blacklists of fraudulent activity or security threats indefinitely in order to protect the security of our Services and your personal data. We share these blacklists with third party service providers in order to continue to improve the security of our Services and your personal data.

In some circumstances we may anonymise your personal data (so that it can no longer be associated with you) for research, statistical or other purposes in which case we may use this information indefinitely without further notice to you.

5. How to access, modify or delete your information

You can access, modify or delete information provided to us through your account and the services/features provided by the application.

If you believe that the information released by this software is inaccurate or violates your privacy, you agree to contact us in time when similar conflicts occur.

If you decide not to use this software any longer or permanently delete all content you uploaded/published/generated, you can permanently cancel your account and all content generated by this account and related data, avatar, nickname through the account cancellation function provided by this software , photo albums, pictures, signatures, IP addresses, chat records, login information and other related data) will be deleted and cannot be retrieved.

Here's how to delete your data or permanently delete your account and everything it has generated:

- If you want to delete the uploaded/published content, you can click the "Delete" button to delete the content completely.

- If you decide to log out of your account, log into your account and navigate to the account settings - click "Logout" - complete the logout.

- If you want to delete your account, log into your account and navigate to the account settings - click "Account deletion" - complete the deletion request. After the processing period, your account and associated personal data will be permanently deleted, and reactivation will not be possible.

- If you cannot complete the above operations or have any questions, please contact the online customer service through the "Customer Service" entry in the App.

6. Children's privacy

These services are not available to anyone under the age of 18. We do not knowingly collect personally identifiable information from children under the age of 18. If we find out it will be deleted from our servers immediately.

If you become aware that we have mistakenly collected information from a child under the age of 18, please contact us so we can delete it immediately.

7. Your legal rights

- Right to know and access. You may submit a verifiable request for information regarding the:

(a) categories of personal data we collect, use or share;

(b) purposes for which categories of personal data are collected or used by us;

(c) categories of sources from which we collect personal data; and

(d) specific pieces of personal data we have collected about you.

- Right to correct. You may submit a verifiable request to rectify inaccuracies in your personal data, taking into account the nature of the personal data and the purposes of the processing of your personal data.

- Right to delete. You may submit a verifiable request to close your account and we will delete personal data about you that we have collected.

- Right to prohibit sale of your personal data. Please note that we do not sell your personal data.

- Right to object profiling and targeted advertising. You may submit a verifiable request to be opted-out from each of the above actions. Please note that these measures may negatively affect your customer experience with our website, app and third party services.

8. Security

Here at Waya Live, we pride ourselves on taking all appropriate security measures to help protect your information against loss, misuse and unauthorised access, or disclosure. We use reasonable security measures to safeguard the confidentiality of your personal information such as secured servers using firewalls.

Unfortunately, no website or Internet transmission is ever completely 100% secure and even we cannot guarantee that unauthorised access, hacking, data loss or other breaches will never occur, but here are some handy tips to help keep your data secure:

- Please make sure you log out of your Account after use as you never know who may stumble onto your Account!

- Please don't share the password you use to access your Waya Live Account with anyone else!

If you ever think someone has had access to your password or Account, please contact us immediately. We cannot guarantee the security of your personal data while it is being transmitted to our site and any transmission is at your own risk.

9. Changes to this policy

As Waya Live evolves, we may revise this Privacy Policy from time to time. The most current version of the policy will govern our use of your information. If we make a change to this policy that, in our sole discretion, is material, we will notify you, for example, via an email to the email associated with your Account or by posting a notice within the app.
